CIRCULAR DATED MARCH 9, 1995

ON DRAFT LAWS APPROVED BY THE COUNCIL OF MINISTERS

 The Royal Government has observed that some ministries represented by their ministers or representatives with the assistance of Khmer or foreign advisors have suggested to the commission of the National Assembly modifications or amendments on draft laws which have been approved by the Council of Ministers that are contradictory to legal principles of solidarity and which runs counter to the policies of the Royal Government and against the decisions of the Council of Ministers.

 Draft laws as submitted by each ministry/Institution and which have been approved by the Council of Ministers shall be considered as draft laws of the Royal Government which cannot be modified or amended without the tacit consent of the Heads of the Royal Government or the Council of Ministers before the discussion and ratification of the National Assembly.

Representatives of the Royal Government who are permitted to defend the draft laws before the commission of the National Assembly may modify or rearrange wordings and sentences but cannot contradict the substance of these draft laws. In the event of a special case which necessitate the modification or amendment of these draft laws, the representatives in charge of defending these draft laws shall first obtain the permission of the Heads of the Royal Government.

Pursuant to the above instructions, the Royal Government shall order heads of institutions the followings:

Upon receipt of this Circular, all ministries and institutions shall be responsible for its implementation.
