DECISION

on

the Creation of National Committee for Reform of

Weapons and Explosives Management in Cambodia

 

 

-              Having seen the Constitution of the Kingdom of Cambodia;

-              Having seen Reach Kret No. NS/RKT/1198/72 of November 30, 1998 on the Appointment of the Royal Government of Cambodia;

-              Having seen Reach Kram No. 02/NS/94, dated July 20, 1994, promulgating the Law on the Organization and Functioning of the Council of Ministers;

-              Having seen Reach Kram No. NS/RKM/0196/09 of January 24, 1996, promulgated the Law on the Creation of the Ministry of Interior;

-              Having seen Anukret N0. 38/ANK/BK of January 30, 1999, on the Management and Control of Importation, Production, Sale, Purchase, Distribution, and Use of all Kinds of Weapons and Explosives;

 

 DECIDES

 

Article  1:

To create the Creation of National Committee for Reform of Weapons and Explosives Management in Cambodia with the following composition:

 

1) H.E. Sar Kheng, Deputy Prime Minister and Co-Minister of Interior

Chairman

2) H.E. Sok An, Senior Minister and Minister in charge of the Council of Ministers

Vice-Chairman

3) H.E. Tea Banh, Senior Minister and Co-Minister of Defense

Vice-Chairman

4) H.E. You Hokry, Senior Minister and Co-Minister of Interior

Vice-Chairman

5) Prince Sisowath Sereyrath, Co-Minister of Defense

Member

6) H.E. Uk Vothun, Minister of Justice

7) H.E. Ker Kimyan, Commander-in-Chief of the Royal Armed Forces

-

8) H.E. Uk Rabun, Secretary of Sate, Ministry of Economy and Finance

-

9) H.E. Em Saman, Secretary of Sate, Ministry of Interior

Article 2:

The Creation of National Committee for Reform of Weapons and Explosives Management shall have following missions:

 

-        To prepare draft laws on the management and use of weapons and explosives;

-        To prepare regulations for implementation that ensure strict management;

-        To define procedures for control, management, use, storage of weapons and explosives at all entities;

-        To determine the quantity of weapons authorized for each entity;

-        To identify entity and composition that are eligible to use weapons and explosives;

-        To collect weapons and explosives from the armed forces to be demobilized and anarchic armed forces;

-        To confiscate and collect weapons and explosives which are illegally possessed, used and kept;

-        To deprive and collect weapons that are scattered and abandoned;

-        To evaluate quality of and categorize weapons and explosives for destruction if a storage of which is unnecessary;

-        To establish relationship with all local and international non-governmental organizations and countries to seek for technical, material, financial assistance; and

-        To conduct dissemination and awareness of laws and reform of weapon and explosives management to the population in order to participate in the maintenance of social security.

 

Article 3:

The National Committee for Reform of Weapons and Explosives Management shall be entitled to create a number of sub-committees to support this activity.

 

Article 4:

This Committee shall have the rights to create an account for allocation of certain budget as determined and shall have the right to use the Ministry of interior's seal.  

 

Article 5:

The Minister in charge of the Council of Ministers, the Co-Ministers of Interior, the Co-Ministers of Defense, the Minister of Economy and Finance, the Minister of Justice, the Commander-in-chief of the Royal Armed Forces, and interested persons listed in Article 1 shall effectively implement this Decision from the date of singature.
