ANUKRET DATED DECEMBER 21, 1994

ON THE MISSIONS AND GENERAL ORGANIZATION OF THE ROYAL MILITARY POLICE

The Royal Government,

having seen the Opinion of the Counselor of National Defense and the Judicial Council of the Prime Minister;

\decides:

 

Article 1:

The Royal Military Police that was previously subordinate to the General Headquarters of Royal Cambodian Armed Forces [INSERT] [shall henceforth] be under the direct command of the Prime Minister.

Article 2: The Prime Minister shall determine the framework of its general activities.

Co-Ministers of National Defense are in charge of the general administration. They shall provide for logistical needs and the budget of the Royal Military Police. The general headquarters of Royal Cambodian Armed Forces shall be responsible for the management,

[training and organization of the Royal Military Police in order that it may achieve its full capacity and to give it a means to ensure its function and its missions].

Article 3: The Royal Military Police shall be part of the Royal Cambodian Armed Forces. It shall have its own autonomy [INSERT] [within its duties defined in Article 4 hereafter]. In the exercise of these police missions, it shall constitute a force with inter-ministerial vocation. Its competence shall be exercised within the whole country, on military and civil citizens.

Article 4: The Royal Military Police shall have for its mission:

a) to ensure the activities of the administrative police:

Within this framework, the Royal Military Police shall act according to instructions of the Co-Ministers of Interior and competent administrative authorities.

b) to ensure activities of the judicial police:

Within this framework, the Royal Military Police shall act in accordance with the instructions of the Minister of Justice, [INSERT], and competent judicial authorities.

c) to accomplish missions of a specifically military character:

Within this framework, the Royal Military Police shall act in accordance with the instructions of Co-Ministers of the National Defense, the Head of the Joint Chiefs of Staff of the Royal Cambodian Armed Forces, and competent military authorities.

d ) to assist those ministries that request it.

Article 5: The Royal Military Police shall be able to be assigned other specific police missions pursuant to later anukrets.

Article 6: The General Structure of the Royal Military Police shall consist of:

The Command of the Royal Military Police is placed under the authority of a Commander, General Officer, and a Deputy Commander.

The Commander of the Royal Military Police shall:

Article 9: The training School of the Royal Military Police shall:

Article 10: The Territorial Military Police:

The Territorial Military Police shall undertake its mission within the whole territory of the Kingdom of Cambodia up to the level of the commune. It shall be charged to accomplish the missions of the Royal Military Police specified in Article 4 of this Anukret.

The competence of the Territorial Police shall be exerted to all military and civil citizens.

 

Article 11: The Mobile Police:

The Mobile Police are a force instituted to maintain order and to fight against illegally armed band. The Mobile Police shall undertake its mission within the whole country at the request of the Territorial Military Police or on requisition of the competent judicial or administrative authority. The Mobile Police shall continually be in a position to strengthen, as soon as possible, units of the Territorial Military Police.

Article 12: The Military Prévôté:

The Military Prévôté shall be one component of the Royal Military Police. It shall act in direct collaboration with the other three branches of the Royal Cambodian Armed Forces. It shall execute its missions under the authority defined in Paragraph "c" of Article 4 of this Anukret.

Article 13: The Inspector and the Commander of the Royal Military Police may propose the creation of other specialized units in order to improve the efficiency of the service.

Article 14: The Prime Ministers shall stop missions, troop strength, and nominations, upon the proposal of the Commander and the Inspector of the Royal Military Police, after advice of the Co-Ministers of National Defense, Co-Ministers of Interior, and the Joint Chiefs of Staff of the Royal Cambodian Armed Forces.

Article 15: Anukret 025-ANK dated June 15, 1994 and the provisions contrary to this Anukret shall be considered void.

Article 16: The Co-Ministers in charge of the Cabinet Council, the Co-Ministers of National Defense, the Co-Ministers of Interior, the Minister of Justice, the Head of the Joint Chiefs of Staff of the Royal Cambodian Armed Forces, and all concerned ministries, shall be responsible for the execution of this Anukret which comes into effect on the date of its signatures.
