The organization and functioning of the
Ministry of Women's and Veteran's Affairs
- Seen the 1993 Constitution of the Kingdom of Cambodia of 1993
- Seen the Kret NS/RKT/1198/72 dated November 30, 1998, Concerning the
appointment of the Royal Government of Cambodia
- Seen the Kram 02/NS/94 dated July 20, 1994 promulgating the law on the
organization and functioning of the Council of Ministers
- Seen the Kram NS/RKM/0999/10 dated September 18, 1999, promulgating the
law on the Establishment of Ministry of Women's and Veteran's Affairs
- Seen the Anukret 20/ANKr-BK dated April 13, 1996 concerning the
organisation and functioning of the ministries and state secretariats
- Approved by the Council of Ministers in its plenary session on the 17
September 1999
HEREBY DECIDES
CHAPTER I : General provisions
Article 1
This Anukret determines the organisation of various entities of Ministry of
Women's and Veteran's Affairs and determines the Ministry's mandate and roles of
the general department and other departments.
CHAPTER II : Mandate and Structure
Article 2
The Ministry of Women's and Veteran's Affairs is delegated by the Royal
government of Cambodia to head and govern the Women's and Veteran's Affairs of
the Kingdom of Cambodia.
Article 3
The Ministry of Women's and Veteran's Affairs has the following roles and
functions:
A/ The Women's affairs:
- to head and govern all social services of the state, civil society to
assist women and assist the vulnerable woman, including elderly and disabled
women and children who are the victim of sexual exploitation etc..
- to design and implement a national policy to promote women
- to promote appropriate measures in protection and ensure the respect of
Women's rights in the family, workplace, and national level
- to promote more women for the understanding and participation in politics,
techniques, and all kind of services, in particular in the economic, judicial,
campaign, education, social development affairs
- to design guidance for parents and guardians to be aware of the family
obligation and to facilitate the functioning of the associations and
non-governmental organisations which serve the interests of women
- to design principles and media education program, training of basic
knowledge for women at the urban and rural levels to facilitate
self-development in co-operation with national and international organizations
- to enter into agreements with countries, national and international
organizations related to women's issues after an approval of the Royal
Government
- to establish statistics and legal documents and dissemination of law
relating to women's issues
- to educate/disseminate the public about the equality of women and men in
the work family, community, and societal environment as well
- to educate/disseminate the public not to commit domestic violence
- to co-operate with the relevant ministries to exercise a measure against
the women and children trafficking and propose measure to prevent woman to be
a prostitute
- to cooperate with the relevant ministries to prevent the transmission of
sexual transmitted disease, especially AIDS
- to celebrate the International Women's Day where to promote the awareness
for women
- to enforce the international convention of the elimination of all forms of
discrimination against women in which the Kingdom of Cambodia became a
signatory on the 22nd of September 1992.
B/ The Veteran's Affairs:
- to organize and exercise a co-ordination process and evaluate the national
policy concerning the veteran's affairs
- to integrate the veterans and their families into the community by
promoting the non-discrimination for a better living standard
- to propose guidance principles to educate the veterans about the value,
duties and roles in the family, community and society to benefit from the
development
- to manage the pension regime and pension for the disabled soldier of the
Royal Armed Force as determined by the Law on Pension Regime
- to manage and furnish compensation for the family of sacrified,
handicapped soldier, and missing combatant.
Article 4
The organizational structures of the Ministry of Women's and Veteran's
Affairs consists of:
- The Cabinet of Minister
- The general inspection department
- The general affairs/administrative department
- The general technical department; and
- The local based entity
The organizational structure of the Ministry of Women's and Veteran's Affairs
is an annex to this Anukret.
CHAPTER III : The Minister's Cabinet
Article 5
The Minister's Cabinet shall be in charge of missions determined by the
provisions of Anukret No. 20 ANK.P date April 30, 1996 as referred in the above
principles regarding the functioning of ministries and state
secretariats.
CHAPTER IV : The General Inspection Department
Article 6
The general inspection department has the following roles:
- to conduct a regular inspection to all entities under the supervision of
the Ministry of Women's and Veteran's Affairs
- to prepare reports for the Minister regarding the functioning of the
inspected entities and improvement measure on the functioning of such entities
- to follow up and control the enforcement of law related to the ministry
jurisdiction
- to perform other duties assigned by the ministry.
The general inspection department shall be headed by one general inspector
and a number of deputy directors as assistants if necessary.
CHAPTER 5 : The General Affairs and Administrative
Department
Article 7
The general affairs and administrative department has the following
roles:
- to establish relationship, co-ordinate, administrative, financial,
accounting, veteran's pension, and statistic affairs.
The general affairs and administrative department shall be headed by one
director general and a number of deputy directors as assistants if necessary.
The general department shall have four departments as the following:
- Department of Administration and Personnel
- Department of Finance and logistics
- Department of Veteran's Pension
- Department of Planning and statistics.
Article 8
The roles of the department of administration and personnel are:
A/ Administrative affairs:
- to co-ordinate all activities of the ministry at the central level and
between the central level and local based entities under the supervision of
the ministry by co-operating with the technical general department,
- to manage and circulate administrative documents of the ministry,
- to manage the state's garage and vehicles allocated to the ministry,
- to ensure the administrative efficiency and safety and manage the
ministry's social affairs,
- to prepare work report and record minutes of meetings related to the
ministry's activities.
B/ Personnel Affairs:
- to control administrative matter of the civil servants and agents of the
ministry through co-operation with the state secretariat for Public Services,
- to prepare all administrative letters relevant to ministry's personnel for
career management,
- to design a program for expertise position and human resources of the
ministry,
- to conduct the training need assessments,
- to set initial and internship training policy in co-operation with the
state secretariat for Public Services and enforce such policy,
- to prepare statistic record on personnel management and table of
operational in formation,
- to evaluate, co-ordinate, promote, or encourage entity or individual who
are under the supervision of the ministry,
- to prepare salary, wages, and social compensation regime policy,
- to perform other duties assigned by the ministry.
The department of administration and personnel shall be headed by one
director and a number of deputy directors as assistants if necessary.
Article 9
The roles of the department of finance and logistics are:
A/ The Accounting and Financial Affairs:
- to prepare the ministry's budget and follow up the operation,
- to combine and adjust chapter of budget,
- to combine and adjust all ministry's expenditures,
- to prepare and co-ordinate the performance of contracts and agreements,
- to properly collect the revenues and transfer into the state budget as
determined by the Financial Law, and
- to cooperate with the financial auditing entity.
B/ The logistic and equipment support:
- to assess equipment need, establish expense program, manage equipment and
material repairs for the Ministry,
- to administer movable and immovable properties, equipment stocks and
prepare inventory lists,
- to set a program of utilisation and distribution of material, equipment
and fuel to institution and entities under its supervision,
- to maintain regular records and account figures,
- to design information technology of financial activities and account
payable,
- to manage account payable, review the technical operation of public
procurement,
- to perform other duties assigned by the ministry.
The department of Finance and logistics shall be headed by one director and a
number of deputy directors as assistants if necessary.
Article 10
The roles of the department of veteran's pension are:
- to prepare all draft laws and regulations related to the veteran,
- to study and establish a regime policy for the veterans,
- to pay, provide, and disburse honorariums for the veterans,
- to plan and manage the statistics and keep records of the veterans,
- to manage retirement regime and pension for the disabled soldier of the
Cambodian Royal Armed Force in accordance with the law on retirement regime
and pension of soldier of the Royal Armed Force,
- to manage and pay compensation to the family of sacrificed, handicapped
soldier, or missing combatant; and
- to perform other duties assigned by the ministry.
The department Veteran pension shall be headed by one director and a number
of deputy directors as assistants if necessary,
Article 11
The roles of the department of planning and statistics are:
- to collect and analyse the statistic data of women and veteran based on
category,
- to design plan and development program for women and veteran in accordance
with the rehabilitation and development measures of the government,
- to design a public policy and collaborate with the non-governmental
organisation to co-ordinate benefits for women and veterans in general,
- to be responsible for public relations,
- to prepare annual plan for socio-economic study to support the measures
and program for Women and Veteran,
- to design development plan for women and veteran by a close co-operation
with the community of non-governmental, national, and international
organizations,
- to set principles, policy, and program to effectively promote the ministry
affairs,
- to follow up, control, evaluate the implementation of work plan and set
the goals for women and veterans development,
- to include the principle of equality of the roles of men and women in the
family/society into the government plan,
- to include national principles concerning the women affected by sexually
transmitted disease especially HIV and AIDS into ministry plan,
- to prepare the report of achievements and other activities of the
ministry,
- to perform other duties assigned by the ministry,
The department of planning and statistics shall be headed by one director and
a number of deputy directors as assistants if necessary.
CHAPTER 6 : The General Department of Technical Affairs
Article 12
The roles of the general department of technical affairs are:
- to establish relationship, co-ordinate, manage the dissemination of the
human resource development, family economic development, Women's health care,
and veteran development,
- to perform other duties assigned by the ministry.
The general department of technical affairs shall be headed by one director
general and a number of deputy directors general as assistants if necessary.
The general department consists of five departments:
- Department of Dissemination;
- Department of Human Resources;
- Department of Family Economy;
- Department of Labour Health Care; and
- Department of Veteran Development.
Article 13
The roles of the department of dissemination are:
- to compile documents concerning the activities of economic/cultural,
policy of women and veterans,
- to establish relationship with all national and international media,
- to produce and disseminate information and documents associated to women's
and veteran's affairs through all kinds of media,
- to publish a national policy concerning women, code of woman, legal texts,
and conduct awareness program related to women and veterans, in co-operation
with ministries, institutions, and local and international non-governmental
organizations,
- to establish and manage a library in order to compile and maintain various
documents, regulations, Customary law, history texts related to the roles and
women issues, and
- to perform other duties assigned by the ministry.
The department of dissemination shall be headed by one director and number of
deputy directors as assistants if necessary.
Article 14
The roles of the department of human resource development are:
- To determine principles and policies for human resource development,
- to draft the law for protection of the interest of women and veterans,
- to educate civil servants of various ministries on the concept of equality
between mans and woman's roles in the family, community, and society,
- to provide education and vocational training's based on the need of labour
market by establishing relationship, education, and direction for all women
centres throughout the country,
- to support the women's and children's roles through a non-academic
education in co-operation with the Ministry of Education, Youth, and Sports
and relevant ministry/institutions and organizations,
- to propose project of general and basic knowledge training's for rural
Women and Veterans in Co-operation with relevant institutions, especially with
the Ministry of Education, Youth, and Sports, non-governmental organizations,
and implement this project,
- to educate/disseminate abut curbing domestic violence, sexual
exploitation, mental health care, and provide services to victims of such
acts,
- to disseminate laws to the authorities and citizens in order to prospect
the victims,
- to disseminate laws to the authorities and citizens in order to protect
the victims,
- to organize about the establishment of child center at all
provincial/municipal communities in co-operation with the Ministry of
Education, Youth, and Sports,
- to perform other duties assigned by the Ministry,
The department of human resource development shall be headed by one director
and a number of deputy directors as assistants if necessary.
Article 15
The roles of the department of family economic development are:
- To thoroughly study about the local based resource and economic status of
citizens at the community levels,
- to study the family's need and train women about basic needs,
- to cooperate with relevant ministries in order to train women in the
community on how to get into business in order to increase their income,
- to encourage by providing capital for small business and skills for family
and community scale farming and animal raising in co-operation with relevant
institutions, non-governmental organizations and private sectors,
- to advise for an improvement of handicrafts to become semi-industrial
ones,
- to advise for an improvement of products to become luxurious for national
and international markets,
- to increase the family living standard at the community level in
co-operation with the ministries, institutions, organizations, and private
sectors in order to create a small scale enterprise through credit system with
low interest rate,
- to co-operate with relevant institutions to train all credit agents,
- to design policy for rural community,
- to perform other duties assigned by the ministry.
The department of family economic development shall be headed by one director
and a number of deputy directors as assistants if necessary.
Article 16
The roles of the department of health care are:
- to strengthen and extend health care of women, mother, and child by
providing information about education and necessary service for women and
family primarily health care, in particularly reproductive health by providing
training for voluntary women at the provincial/municipal and Community levels
in co-operation with relevant ministries for technical aspects especially the
Ministry of Health,
- to participate in the prevention of AIDS transmission,
- to perform other duties assigned by the ministry,
The department of health care shall be headed by one director and a number of
deputy directors as assistants if necessary.
Article 17
The roles of the department of veteran development are:
- To help the veterans in education, vocational training, seeking for job
and business,
- to help develop the community to improve the living conditions of the
veterans and their families,
- to manage funds and provide credit to the veterans and their families,
- to participate in the organization of national ceremonies of the veterans,
- to perform other duties assigned by the ministry.
The department of veteran development shall be headed by one director and a
number of deputy directors as assistants if necessary.
CHAPTER VII : The Financial Auditing Institution
Article 18
The Financial Auditing Institution shall be established by the Ministry of
Economy and Finance under the terms of the provisions of Anukret No. 81 dated
November 16, 1995 concerning the establishment of a financial auditing
institution for the ministerial expenditure budget.
CHAPTER VIII : The Local Based Entity
Article 19
There shall be a provincial/municipal women and veteran office
at each province/municipality to be in charge of implementating and
co-ordinating the of ministry activities. At the district or sub-district level
there shall be a Women's and Veteran's Affairs office which is in charge of and
co-ordinating ministerial activities.
Article 20
The organization and functioning of the ministry at the central
administration beginning from the levels below department ones shall be
determined by a Prakas of the Ministry of Women's and Veteran's Affairs.
Article 21
Any roles/duties which are related to other competent institutions, the
Minister of Women's and Veteran's Affairs and director of such institutions
shall collaborate to allocate the responsibilities and perform such
responsibilities by a joint Prakas of the Minister of Women's and Veteran's
Affairs and directors of such institutions.
Article 22
The Anukret 24 ANKr-BK dated April 29, 1998 concerning the organization and
functioning of the ministry of Women's and Veteran's Affairs and any provisions
which are contrary to this Anukret shall be abrogated.
Article 23
The Minister in charge of the Council of relevant Ministers, Ministers, and
state secretariats, relevant ministries, institutions shall be accountable for
the enforcement of this Anukret from the date of signature herein.
